1 Terms and conditions

1.1 General

  1. The Giveaway is conducted and administered by the State of Queensland, acting through the Department of Environment and Science ABN 46 640 294 485 (the Department).
  2. Entry into the Giveaway is deemed acceptance of these Terms and Conditions.
  3. If there is any inconsistency between these Terms and Conditions and anything else that refers to this Giveaway, these Terms and Conditions will prevail.
  4. The Department reserves the right to vary these Terms and Conditions, or suspend, terminate or cancel the Giveaway at any time, and at its sole and absolute discretion and without notice.
  5. Following any variation of these Terms and Conditions, the Department may re-upload the updated Terms and Conditions to its website.
  6. All decisions made by the Department throughout the Giveaway are final and binding and no correspondence will be entered into.
  7. The Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram.
  8. By entering the Giveaway, entrants agree to follow any Conditions of Entry, set by the Department. Each entrant is responsible for ensuring they are aware of and comply with all Conditions of Entry for the Safer Schoolies, nightly ‘Schoolies Hub’ which is to be held on the beach at Surfers Paradise.


1.2 Details of the Giveaway

  1. There are two parts to this Giveaway (collectively ‘the Giveaway’):
    1. firstly, the entrant must register to obtain a wristband to the Safer Schoolies, nightly 'Schoolies Hub’ to be held on the beach at Surfers Paradise (Wristband Registration); and
    2. secondly, if the entrant registers to obtain a wristband, they may also elect to enter the draw to win one of five Apple AirPods Max and complete the required steps to do this (set out below) (AirPods Registration).
  2. The Giveaway will open at 7.00am on Monday 15 August 2022 and conclude at 5.00pm on Friday 26 August 2022 (the Giveaway Period).
  3. The Giveaway, will be undertaken during the Giveaway Period.
  4. The prize draw for the five Apple AirPods Max will take place at 12.00pm Monday 29 August 2022. Winners will be notified via social media, email, SMS and/or mail in the Department’s sole and absolute discretion.


1.3 Who can enter, how to enter

  1. Any person finishing Year 12 in Queensland in 2022, with a current Year 12 student photo ID card, who will be attending Schoolies on the Gold Coast is eligible to enter the Giveaway.
  2. Employees and contractors of the Department and their immediate families are ineligible to enter the Giveaway.
  3. Entrants under the age of 18 years must have the consent of their parent or guardian to enter the Giveaway.
  4. No payment is required to enter the Giveaway.
  5. To obtain a wristband for the Safer Schoolies, nightly 'Schoolies Hub’, entrants must complete the registration form located on the Department’s website and follow the instructions on the SchooliesGC official Instagram Giveaway post (posted 11 August 2022) (the Wristband Registration Requirements).
  6. To be eligible to receive one of five Apple AirPods Max, the entrant must:
    1. reside in the state of Queensland;
    2. be a person finishing Year 12 in Queensland in 2022, with a current Year 12 student photo ID card;
    3. complete the Wristband Registration Requirements, including inserting their Instagram handle into the registration form;
    4. like the SchooliesGC and Queensland Youth Instagram pages;
    5. like the ‘Wristband Registration’ post pinned to the top of the SchooliesGC Instagram page; and
    6. tag the friends who they are going to Schoolies with in 2022, (the AirPods Registration Requirements).
  7. The entrant is responsible for ensuring the Wristband and (if applicable) AirPods Registration Requirements have been met.
  8. The Wristband Registration Requirements will be deemed to be accepted at the time of receipt by the Department’s website and not at the time of submission.
  9. The AirPods Registration Requirements will be deemed to be accepted once:
    1. the Wristband Registration Requirements have been completed in accordance with (g) above; and
    2. the entrant has liked the Schoolies CG and Queensland Youth Instagram pages, liked the ‘Wristband Registration’ post pinned to the top of the Schoolies GC Instagram page, and has tagged the friends who they are going to Schoolies with in 2022.
  10. Incomplete, inaccurate, erroneous, ineligible or incomprehensible registration forms will be deemed invalid and not eligible to enter the Giveaway.
  11. All valid entries received within the Giveaway Period will be entered into the prize draw. Only one entry per person is permitted. If multiple entries are submitted by a single entrant, only the first valid submission will be accepted.
  12. All information submitted by an entrant must be true and correct as at the time of completion.
  13. Entrants must complete the Wristband and (if applicable) AirPods Registration Requirements, during the Giveaway Period be eligible to win one of five Apple AirPods Max.
  14. Late, and/or partially completed registration forms that do not satisfy the Wristband Registration Requirements may be determined by the Department as ineligible for participation in the Giveaway.
  15. The Department reserves the right, at any time, to:
    1. verify the validity of a registration form, reject a registration form or disqualify a registration form, in its sole and absolute discretion; and
    2. deem any entry invalid in its sole and absolute discretion.
  16. By entering the Giveaway, entrants are providing consent for the Department to collect, use and disclose the entrant’s personal information to determine the entrant’s eligibility to enter and to win the Giveaway.
  17. The Department is not responsible for late, lost or misdirected entries including whether caused by problems with:
    1. communication networks or lines, computer systems, software or internet service providers, third party websites, congestion on any carrier network or otherwise; or
    2. any theft, destruction or unauthorised access to, or alteration of such communications; or
    3. any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Giveaway.

1.4 Prize

  1. The five Apple AirPod Max’s, will be awarded to valid entries selected at random by the Department. The draw will be final.
  2. The Department reserves the right to require proof of age, parental or guardian consent, residency or any other eligibility criteria the Department considers relevant, before an entrant can be awarded a prize.
  3. If the five Apple AirPod Max’s are unavailable, the Department, in its sole and absolute discretion, reserves the right to substitute the prize with a prize of approximately equal value and/or specification.
  4. The prize cannot be transferred, exchanged or redeemed for cash. If for any reason the winner:
    1. does not accept or take the prize;
    2. is ineligible to receive the prize or to participate in the Giveaway;
    3. has not complied with these Giveaway Terms and Conditions; or
    4. has not complied with any obligation or condition required by the Department to accept the prize,
    by Thursday 1 September 2022 (AEST), then the prize will be forfeited by the winner and cash will not be awarded in lieu, and the Department reserves the right to select an alternate winner or no winner.
  5. The Department will not engage in any correspondence with any entrant, person or entity regarding the Giveaway or any winners.
  6. The Department reserves the right, in its sole and absolute discretion to disqualify any entrant, or vary, suspend or terminate the Giveaway at any time without liability to any entrant or other person. The Department will not award any prize if this Giveaway is terminated.
  7. The Department is not responsible for and will not replace or substitute the prize if it becomes lost in the process of sending it to the entrant, lost by the entrant and/or damaged and/or stolen before or after coming into the entrant’s possession.


1.5 Intellectual property and licensing

  1. Intellectual property rights in an entry or a photograph of the entrant will remain the property of the entrant (or where the work is owned by a third party, that third party).
  2. The entrant grants (or will procure for the Department from a third party) to the Department, a non-exclusive, royalty free, world-wide licence (including the right to sub-licence) to use, adapt, reproduce, publish and exploit such intellectual property, for any purpose of the Department.
  3. Entrants agree that the Department may use their name and photograph (including photographs taken by the Department) for promotional purposes and agree to their name being shared on social media, and the prize winner agrees to the Department posting the prize winner’s entry on the Department’s social media accounts.
  4. By entering this Giveaway, all entrants:
    1. agree not to assert any moral rights in respect of their entry, any photos taken of the entrant and the publicity materials (wherever and whenever such rights are recognised) against the Department, its assignees, licensees and successors in title; and
    2. warrant to the Department that their entry is not in breach of any third party intellectual property rights.


1.6 Privacy

  1. Personal Information collected by the Department, will be handled in accordance with the Information Privacy Act 2009 (Qld).
  2. The type of personal information the Department may collect includes the entrant’s name, email address, photograph, phone number, location and any other personal information expressly stated to be collected in these Terms and Conditions.
  3. The entrant’s personal information will be collected, used, published and disclosed for the administration and promotion of the Giveaway and its associated activities, and for any other purpose expressly permitted under these Terms and Conditions, and as authorised or required by law.
  4. The entrant’s personal information may be disclosed to third parties such as the Department’s employees, contractors, ambulance/police officers (if required to assist the entrant) and associated service providers.
  5. As a condition of entry, the entrant consents to their personal information being collected, used, published or disclosed by the Department for the purposes stated in these Terms and Conditions.

  8. The Giveaway is being conducted using third party social media software (Instagram) which is based in the United States of America. The entrant acknowledges that the Department is subject to the terms and conditions of the social media providers, which may allow those providers unrestricted use and modification of submitted information, including use and storage of information outside Australia. The Department makes no representations about those third parties, and gives no warranties that it can control how your information is used, stored or modified by third parties. The Department is not responsible for the content, security and privacy practices of third parties, and entrants must make their own investigations as to the suitability of such third party software and applicable third party terms of use and privacy terms.


1.7 No Liability

  1. The Department is not responsible for:
    1. any incorrect or inaccurate information, either caused by the entrant or any of the equipment or software associated with, or utilised in this Giveaway; or
    2. for any technical error, or combination thereof that may occur in the course of the administration of the Giveaway, including any omission, interruption, deletion, defect, congestion, delay in operation or transmission, communications line or telephone, mobile, internet, computer or satellite failure, theft or destruction or unauthorised access to, or alteration of applications.
  2. If for any reason, this Giveaway is interfered with in any way or is not capable of running as planned, including due to infection by computer virus, bugs, tempering unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Department which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Giveaway, the Department reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the Giveaway.
  3. Except for any liability that cannot be excluded by law, the Department (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury, loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, in connection with the Giveaway, including but not limited to the following:
    1. any technical difficulties or equipment malfunction, including as a result of downloading any materials for/in the Giveaway (whether or not under the Department’s control);
    2. any theft, unauthorised access or third party interference;
    3. any entry, submission or acceptance that is late, lost, altered, damaged or misdirected due to any reason, whether in the control of the Department or not;
    4. any delay, cancellation, suspension or termination or variation of the Giveaway;
    5. any prizes which are lost, misdirected or for any reason, not received by the winner, whether or not posted by the Department;
    6. any variation in prize or prize value to that stated in these Terms and Conditions;
    7. any tax liability incurred by the winner;
    8. the publication of any material relating to the Giveaway; and/or
    9. participation in the Giveaway.
  4. In the event that liability cannot be excluded under these Terms and Conditions, the Department’s liability is limited to $100(AUD).
  5. Entrants must only participate in the Giveaway (including using third party software if applicable) in a manner that does not infringe the rights of others or restrict or inhibit the participation of others in the Giveaway. This includes refraining from conduct which:
    1. is unlawful;
    2. may harass or cause distress or inconvenience to any person;
    3. involves the transmission of obscene or offensive content; or
    4. brings the Department or Giveaway into disrepute.
  6. An entrant must not post or transmit, any unlawful, defamatory, obscene, offensive or scandalous material, or any material that constitutes or encourages conduct that would contravene any law.
  7. If an entrant breaches these Terms and Conditions, the Department may immediately and without notice, terminate their participation in the Giveaway.
  8. Any costs associated with accessing social media sites and mobile applications is the entrant’s responsibility.


1.8 Survival

If the Giveaway or an entrant or winner’s participation in the Giveaway is terminated, clauses 1.1(b), (c), (d), (e), (f), (g), 1.4(f), 1.4(g), 1.5, 1.6, 1.7, 1.8 and 1.10 survive that termination.

1.9 Entire agreement

These Terms and Conditions form the entire agreement and understanding between the Department and the entrant for the Giveaway.

1.10 Governing law

The Giveaway is conducted in Queensland, via the internet and is subject to the laws of Queensland, and the exclusive jurisdiction of the courts of Queensland.
